Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Graded Investors ("Graded Investors," "we," "us," or "our"), a business operating in the United States. By accessing our website, creating an account, submitting cards for grading, or purchasing from our store, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use our website or services.

We may update these Terms from time to time. Changes take effect when posted, and your continued use of the services after changes are posted constitutes acceptance of the updated Terms.

You must be at least 18 years old, or the age of majority in your state, to use our services. You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly at info@gradedinvestors.app if you believe your account has been used without authorization.

Account roles and permissions are managed by us. You may not attempt to change your own account type, obtain administrative access, or access data belonging to other users.

Graded Investors is a grading concierge. We pre-check the cards you send us, advise which cards we believe are worth grading, and submit accepted cards to third-party grading companies (including PSA, BGS, CGC, SGC, and TAG) on your behalf. We are an independent service and are not affiliated with, endorsed by, or acting as an agent of any grading company.

Our pre-check and submission fee is a flat rate of $5 per card. This is our service fee only — each grading company's own grading fees are separate and are billed to you directly, sometimes as additional invoices from us (including where you arrange a payment plan). We invoice our fee after we perform the pre-check; there is no upfront charge to submit. Cards we decline at pre-check are not charged our pre-check fee and are returned to you or held per your instructions.

Grading is performed by the third-party grading company using their own standards, timelines, and fee schedules. We do not control and do not guarantee any particular grade, turnaround time, or outcome. Grading-company fees, return shipping, insurance, and applicable taxes are separate from our concierge fee and will be communicated to you in connection with your order.

When you submit an order, you are responsible for packaging your cards securely and shipping them to us at: Graded Investors, 401 McElroy Dr Unit 1688, Oxford, MS 38655-2393, US. We strongly recommend using a trackable, insured shipping method. Title and risk of loss for cards in transit to us remain with you until the cards are received and logged into our system, and pass back to you once we hand your returned cards to the carrier.

As a convenience, you may optionally purchase a prepaid shipping label from us during the submission process. The price of a prepaid label is the carrier's postage plus a processing fee, and any insurance is optional and set by you at the value you declare. Buying a prepaid label does not change the allocation of risk of loss above, and we are not the carrier; the carrier's own terms, coverage limits, and claims process apply to any lost, delayed, or damaged shipment.

You confirm the recipient name shown in the app so that we can match your package to your account. We are not responsible for items lost, delayed, or damaged by shipping carriers, or for packages that cannot be matched to an account because they were not labeled as instructed.

Payments are processed by our third-party payment processor, Stripe. We do not collect or store your full card details. You agree to pay all fees and applicable taxes associated with your orders and invoices when due. Invoices for grading services are issued through Stripe and are payable by the date shown on the invoice.

If an invoice is not paid, we may pause work, hold your cards until payment is received, or cancel the order. You are responsible for any fees charged by grading companies for services performed at your direction.

Our online store offers physical goods subject to availability. Prices, promotions, and availability are shown at the time of purchase and may change without notice. Your order is an offer to buy, and we may accept or decline it — for example, if an item is out of stock or a pricing error occurred. If we cancel an order after payment, we will refund the amount charged.

Shipping charges are calculated from live carrier rates for the address you provide and are shown before you pay. You are responsible for providing a complete, accurate, deliverable U.S. address. If a package is undeliverable or returned to us because of an incorrect address or a failure to accept delivery, any re-shipment will be at your expense. Return shipping for graded cards, where applicable, is billed to you separately at carrier rates plus any insurance you request. Depending on your jurisdiction, sales tax may apply to shipping charges; any tax shown at checkout is collected as required.

Ownership and risk of loss for purchased goods pass to you when we deliver the goods to the carrier. Shipping timeframes are estimates and are not guaranteed.

You agree not to misuse the website: no attempting to gain unauthorized access, no interfering with the service or other users, no submitting counterfeit, stolen, or misrepresented items, and no using the service for any unlawful purpose. We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to us, our users, or third parties.

The website, its design, text, graphics, and logos are owned by Graded Investors or our licensors and are protected by intellectual-property laws. You may not copy, reproduce, or create derivative works from our content without our prior written permission. Trademarks and card imagery belonging to third parties (including grading companies and card manufacturers) remain the property of their respective owners.

The website and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

We do not warrant any specific grade, valuation, authentication result, or turnaround time. Estimated card values, grading recommendations, and pre-check opinions are our good-faith assessments and are not guarantees or investment advice.

To the fullest extent permitted by law, Graded Investors and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or relating to your use of the website or services.

Our total liability for any claim relating to a grading order or store purchase will not exceed the amount you paid to us for that order, except where a greater amount is required by applicable law. Nothing in these Terms limits liability that cannot be limited under law.

You agree to indemnify and hold harmless Graded Investors from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the services, your breach of these Terms, or your submission of items you did not have the right to submit.

These Terms are governed by the laws of the State of Mississippi and applicable U.S. federal law, without regard to conflict-of-law principles. You agree that the state and federal courts located in Mississippi will have jurisdiction over any dispute that is not otherwise resolved, and you consent to venue in those courts.
